Reasonable Care: Two Cases That Illustrate Its Vital Importance

  • Peter T. Tomaras CHA FMP
  • 7 August 2024
🛌 In a major franchisor's motel, a woman sustained a Smith’s Fracture from an electric shock while grabbing an aluminum handrail; management was previously aware of electric shock incidents. The hotel GM was informed but didn't investigate thoroughly, resulting in a lawsuit where the hotel-owning company was the primary defendant due to the legal doctrine of respondeat superior. In a separate incident at a 5-star North African hotel, an American guest fell down a non-code-compliant stairway, suffering permanent paralysis. Employees incorrectly moved him, exacerbating the injury. The hotel's lack of reasonable care and inadequate employee first-aid training were seen as the proximate cause of the severe injuries.

Google could be forced to change search

  • Automatic
  • 7 August 2024
🔎 On August 7, 2024, a U.S. ruling targeted Google's default search engine status, potentially stopping multi-billion dollar payments for secure positioning. Alternatives could mirror Europe's Digital Markets Act, prompting user choice for services. An extreme outcome may entail Google separating its search division or facing antitrust fines. Immediate effects are unlikely as Google intends to appeal, causing legal entanglements and delays. Full details at The Guardian.

New York City is about to get rid of about 75% of its pandemic-era outdoor dining structures

  • Joanna Fantozzi
  • 5 August 2024
🍴 In New York City, the Dining Out NYC program began accepting applications in March and closed them on August 3, receiving only 3,226 submissions from over 12,000 restaurants and bars that used the temporary outdoor dining setup during COVID-19. Approved applicants have 30 days to comply with new standards or face fines starting at $500. Outdoor dining is now standardized with options for partially covered or al fresco roadways and sidewalks, costing a $1,050 four-year license fee or $2,100 for both, plus an annual fee based on size and location. The city aims to create the largest inclusive outdoor dining program in the country.

🛏 On July 18, New York City Councilwoman Julie Menin proposed Int. No. 991, with revisions introduced on August 2 that fail to address critical issues for hotel stakeholders. The bill mandates direct employment for housekeeping, room attendance, and maintenance staff by hotel owners, prohibits subcontracting, and may force some hotels to close or be sold. The American Hotel & Lodging Association warns of catastrophic consequences, including hotel closures, mass layoffs, and damage to New York’s economy and tourism.
